Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of UseGuide (the "Service"), operated by Amwhiz Media Private Limited ("Amwhiz", "we", "us", or "our"). By creating an account, accessing, or using the Service, you agree to these Terms and our Privacy Policy.

1. Eligibility

You must be at least 18 years old and capable of forming a binding contract under applicable law. If you use the Service on behalf of an organisation, you represent that you have authority to bind that organisation to these Terms.

2. The Service

UseGuide is a software platform that helps users create, edit, translate, and share product tutorials and documentation generated from screen recordings. Features and availability may change over time.

3. Accounts

  • You must provide accurate and complete information when creating your account.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • You must notify us immediately at hello@useguide.io of unauthorised access.
  • One account is intended for one person; use workspace invitations for teams.

4. Acceptable use

You agree not to:

  • Use the Service unlawfully or in violation of applicable law.
  • Record or capture material featuring any person without required consent.
  • Upload illegal, infringing, defamatory, obscene, or malicious content.
  • Reverse engineer, scrape, abuse, or interfere with the Service or its infrastructure.
  • Resell, sublicense, or commercially exploit the Service beyond your plan rights.
  • Use the Service in ways that violate downstream provider acceptable-use policies.

5. Your content

You retain ownership of the recordings, media, text, and other materials you upload or generate using the Service. You grant Amwhiz a worldwide, royalty-free, non-exclusive licence to host, store, transcode, transcribe, translate, and otherwise process that content solely to provide and improve the Service for you.

6. AI-generated output

The Service uses third-party AI providers to generate narration, transcripts, translations, and other output. AI output may contain inaccuracies, and you are responsible for reviewing and validating it before publishing or relying on it.

7. Subscriptions, credits, and billing

  • UseGuide offers a Free plan and a paid Pro plan, as described on the pricing page.
  • Credits power AI-intensive features and are non-transferable, have no monetary value, and do not roll over unless stated otherwise.
  • We may offer a 7-day free trial of Pro that does not auto-convert into a paid subscription.
  • Paid subscriptions are processed by Paddle, our Merchant of Record, which handles billing, taxes, and invoicing.
  • Subscription fees are billed in advance on a recurring monthly basis until cancelled.

8. Cancellation, downgrades, and refund policy

All sales are final and non-refundable.

  • No refunds are provided for cancellations, downgrades, unused credits, inactivity, or dissatisfaction with AI-generated output.
  • You may cancel your Pro subscription at any time through billing settings.
  • After cancellation, Pro features remain active until the end of the current billing period, then the account downgrades to Free.
  • Your account and previously created content remain accessible subject to Free-plan limits.

9. Suspension and termination

We may suspend or terminate access, without refund, if you breach these Terms, abuse the Service, or engage in fraudulent or illegal activity. You may terminate your account at any time by deleting it from settings or contacting us.

10. Third-party services

The Service integrates with third-party providers including Paddle, Google, OpenAI, ElevenLabs, Lovable Cloud infrastructure, Railway, and others. Use of features that depend on them may also be subject to their terms and privacy policies.

11. Intellectual property

The Service, including all software, design, trademarks, logos, and content other than your own content, is owned by Amwhiz Media Private Limited and protected by applicable intellectual property laws.

12. Disclaimers

The Service is provided "as is" and "as available", without warranties of any kind, express or implied.

13. Limitation of liability

To the maximum extent permitted by law, Amwhiz and its affiliates will not be liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill arising from or relating to the Service.

Our aggregate liability for any claim arising out of or relating to the Service is limited to the greater of the total amount you paid us in the preceding twelve months or USD 100.

14. Indemnification

You agree to indemnify and hold harmless Amwhiz Media Private Limited and its affiliates from claims, damages, liabilities, and expenses arising from your content, your use of the Service, or your breach of these Terms.

15. Governing law and jurisdiction

These Terms are governed by the laws of India. Any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the competent courts at Chennai, Tamil Nadu, India.

16. Changes to these Terms

We may modify these Terms from time to time. Material changes will be notified via email or in-app notice before they take effect. Continued use after the effective date constitutes acceptance of the updated Terms.
